How does a Motor Vehicle Accident claim work?
If you have been injured in a car accident, you may be entitled to compensation for pain and suffering, past and future loss of income, and future medical treatment. Even if you are at fault for a collision, you may be entitled to claim Accident Benefits from your own insurer or from another insurance company.
We first work on Accident Benefits and then determine if we’re going to pursue a tort claim (which means that you may sue the at-fault or partially at-fault party).
What are Accident Benefits?
Accident Benefits are available to any person that is injured in an MVA. This is known as “no-fault” insurance coverage. Accident Benefits are usually paid for by your insurance company. If you don’t have an insurance policy, priority rules will determine which insurance policy will cover you.
How long does it take to settle an Accident Benefits Claim?
Insurance companies are not allowed to settle an Accident Benefits Claim until one year after the date of loss. Depending on your circumstances and negotiations with your insurance company, it may take longer to reach a fair settlement.
Accident Benefits include:
- Income Replacement Benefits (if you are unable to return to work following a car accident)
- Non-Earner Benefits
- Attendant Care Benefits
- Medical and Rehabilitation Benefits (for Physical and Mental Injuries)
- Death and Funeral Benefits
- Optional Benefits (including Housekeeping and Caregiving Expenses)
Should you sue?
If someone else is at-fault, you may pursue a tort claim against them, which means that you may sue them.
Tort claims include:
- Pain and suffering
- Economic loss
- Loss of competitive advantage
- Medical expenses
- Out-of-pocket expenses
- Housekeeping expenses
- Family law claims
If you wish to pursue a claim against the at-fault party for pain and suffering, your injuries must meet the threshold of permanent and serious impairment of an important physical, mental, or psychological function.

Documenting your claim is the most important part of the process. This means confirming your ailments with your doctor, seeking the care you need, and continuing to document how you’ve been impacted at home and with work responsibilities.
